- Transgenders not given separate identity in state
- Transgender has been not recognised as a separate gender in the J&K constitution and as such, no legislation has been either contemplated or enacted to do so.
- This was informed by Social Welfare Minister Sajjad Gani Lone in a reply to a calling attention notice by PDP MLC Khurshid Mohammad Alam in the Legislative Council on the situation arisen due to absence of a policy for the uplift and rehabilitation of transgenders in the state.
- The minister said in respect to the specific demand made for recognition of transgender as a third gender, the said classification would require massive statutory amendments which required thorough examination and deliberations being a subject of the state list of the Indian Constitution.
- Khurshid Alam said a newly born child does not know what gender he/she is born with. “But after growing as a transgender in society, he/she is disowned and is left to live a life of penury and subjugation. There is no government policy to bring transgenders in the mainstream as no social, economic or political empowerment is given to them. Having no acceptability in the social stratum, transgender children are bereft of education and other facilities which leaves them begging in streets for livelihood.”
